An Impending Samsung-Apple Truce In Australia

After yesterday’s hearing in an Australian court, where Apple senior executive Richard Lutton presented evidence that Apple founder Steve Jobs initiated talks with Samsung to not launch their patent infringing Samsung Galaxy Tab 10.1., things took a surprising turn.

Samsung lawyer David Catterns made a proposal to resolve their patent dispute in Australia regarding touch-screen technology.  Apple lawyer Steven Burley said that they will need time to consider Samsung’s offer.

Earlier this week, Samsung already agreed to withdraw two features from the Galaxy Tab 10.1 that allegedly infringes Apple’s patent.  Samsung’s move reduced their dispute in the Australian court.

Details of the proposal were not made public but if Apple accepts the proposal, this would end their battle.  And depending on what they agree on, the Galaxy Tab 10.1 could finally grace the Australian soil.

Yesterday, Federal Court Justice Annabelle Bennett stated that she would hand down the ruling next week as to whether or not grant Apple’s request for an injunction.  But today, Benett said that, “I can’t promise when I’ll make a decision.  I will try to get it out as soon as possible.”  Also, Benett urged both parties to consider an early trial over patent claims by the last week of October.

Today’s hearing was inconclusive, so another hearing is scheduled on October 4 after a New South Wales’ public holiday.
